Terms & Conditions

These General Terms and Conditions apply to all contracts between Wolfgang Pfeifhofer – Ski & Mountain Coaching, Färbergasse 19/1, 5600 St. Johann im Pongau, Austria (hereinafter “we”) and our customers (hereinafter “contracting party”). They are based on the General Terms and Conditions of the Salzburg Ski & Snowboard Schools. This translation is provided for convenience; in case of doubt, the German version shall prevail.

1. General

Unless expressly agreed otherwise, these terms apply to all legal transactions and contractual relationships with us. We offer private skiing and snowboarding lessons as well as guided ski touring, freeride, cross-country skiing and snowshoe hiking.

2. Booking, conclusion of contract and prices

Booking requests can be made via the form on our website, by phone or by email. A request is not yet a binding booking. We check the requested date and, if it is available, send an invoice with an online payment link by email. The contract is concluded with this written confirmation; the date is firmly booked once payment has been received.

Our offers are non-binding. Verbal or telephone side agreements are only valid if confirmed by us in writing.

All prices are quoted in euros and, unless agreed otherwise, include statutory VAT. Prices are subject to change; errors and misprints excepted.

3. Payment

Unless agreed otherwise, the invoice amount is to be paid via the online payment link within the period stated on the invoice, but no later than before the start of the service.

In the event of late payment, we are entitled to charge statutory default interest.

4. Conditions of participation

The contracting party must provide us with truthful and complete information about their skills and experience in the respective snow sport, as well as about their state of health and any conditions that may affect their ability to take part or may become acute during the activity.

The contracting party is responsible, at their own expense, for equipment suited to their ability and the conditions, and must have it — in particular the bindings — inspected and adjusted by a specialist shop beforehand. Safety equipment for ski touring and freeride (avalanche transceiver, shovel, probe) is provided free of charge if needed. We are not liable for damage resulting from improper or insufficient inspection, adjustment or maintenance of the participant’s own equipment. Participation may be refused if the equipment is unsafe or defective until the defect has been remedied, without any entitlement to a reduction of the fee for missed time.

The coach’s instructions must be followed. Disregarding instructions or warnings, or being under the influence of alcohol or drugs, entitles us to terminate the contract immediately. In these cases there is no entitlement to a refund.

5. Photos

Photos may be taken during the coaching and published on our website and social media channels. If you do not want this, please let us know beforehand.

6. Liability

We strongly recommend taking out health, accident, liability and travel health insurance. In accordance with the statutory provisions, we are only liable for damage connected with our activities that was caused intentionally or through gross negligence. We hold appropriate liability insurance. We are not liable if the contracting party is injured, suffers damage or causes damage by disregarding instructions, the FIS rules of conduct, legal regulations or these terms.

7. Complaints

Complaints must be reported immediately, either directly to the coach or by email to info@wolfgang-pfeifhofer.at, so that the issue can be resolved quickly. Claims for a reduction of the fee can no longer be considered if the complaint is not raised by the end of the service at the latest. Any other claims must be submitted in writing, with reasons, no later than four weeks after they arise or become known.

8. Cancellation

All bookings can be cancelled free of charge until 5 p.m. on the day before. After that, the booked rate will be charged. Please cancel by email to info@wolfgang-pfeifhofer.at or by phone at +43 664 340 22 12.

In the event of illness or accident, we will find an individual solution together (cancellation or rescheduling).

Safety comes first: we adapt the route and programme to the participants’ ability and to the weather, snow and avalanche conditions. If the avalanche danger is too high or the weather is dangerous, we will reschedule the date free of charge.

No refund is given for failure to attend the agreed date or for termination by the contracting party.

Lift passes are not included in the price and must be paid for by the contracting party. We provide no compensation for time lost due to cable car or lift outages.

9. Safety

Under the Salzburg State Sports Act 1988 (LGBl. No. 98/1987), children and adolescents under the age of 15 must wear a ski or snowboard helmet complying with ÖNORM EN 1077:2007 when skiing or snowboarding. All participants must familiarise themselves with and observe the FIS rules of conduct.

10. Place of jurisdiction, place of performance, applicable law

The place of performance is St. Johann im Pongau. The court having local and subject-matter jurisdiction for St. Johann im Pongau shall have jurisdiction over all disputes arising from the contractual relationship. Austrian law applies. Mandatory consumer protection provisions remain unaffected. The contract language is German.

11. Severability

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions and of the contract shall not be affected. The invalid provision shall be replaced by one that comes closest to it in economic terms. Amendments to these terms must be made in writing.
